City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCIN TO <br />KUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1308 <br />WHEREAS, Robert Owens (hereinafter "the applicant") is the owner <br />of the property located at 1700 Bohn's Point Road within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Exhibit A, attached, (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.22, Subdivision 2 to permit the <br />replacement of an existing deck which contributes to hardcover in the 75- <br />250' lakeshore zone in excess of the 25% hardcover normally allowed. <br />NON, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1308. <br />2. The property is located in the LR-lB Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on July <br />18, 1988, and recommended approval of the proposed variance based upon <br />the following findings: <br />A) During the necessary dismantling of the previously existing <br />deck stairway in order to make repairs to the lakeshore <br />which was damaged during the 1987 super -storm, it was found that <br />the pre-existing deck was infested with carpenter ants and was no <br />longer safe for use. The applicant's contractor subsequently <br />designed a replacement deck of similar square foo-cage and <br />slightly different shape and commenced construction without the <br />required permit. <br />B) The replacement deck comprises of approximately 400 s.f. of <br />hardcover and is located 90' from the lakeshore, 10' from the <br />side lot line, and behind the average lakeshore setback line. <br />The only variance needed for approval of this deck is for <br />hardcover in the 75-250' zone. <br />Page 1 of 4 <br />
