Mike Gaffron, indicates that the City has not previously denied <br />buildability in any similar sewer situation, and that the <br />granting of variances in the present case would not set advicerse <br />precedent. The number of similar lots which are undeveloped, and <br />therefore potential building sites, if any, is negligible. In <br />short, there is no rational basis upon which the present <br />application can be denied, and to do so might well subject the <br />City to an action for both an injunction and money damages.
