Tract B, except the easterly 35 feet thereof parallel with and measured at a right <br /> angle to the easterly line of said Tract B: Tract C, and Tract D, except the <br /> southerly 28 feet parallel with and measured at right angles to the southerly line of <br /> said Tract D, all in Registered Land Survey No. 488, files of Registrar of Titles, <br /> • Hennepin County,Minnesota. <br /> (hereinafter the"property"); and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 10.22, Subdivision 1B to allow <br /> the construction of a deck addition encroaching 105' past the average lakeshore setback. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono,Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#02-2809A. <br /> 2. The property is located in the LR-1B Lakeshore Residential Zoning <br /> District, which requires an average lakeshore setback of 75 feet and no <br /> closer to the lakeshore than the average distance from the shoreline of <br /> existing residence building on adj acent lots. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on July 21, 2003 and recommended approval of the average lakeshore <br /> setback variance based on the following findings: <br /> � <br /> Page 1 of 5 <br />
