� o.�,. . <br /> � � <br /> • � �_ � ° <br /> z CITY of ORONO <br /> ,� - .,. � <br /> ,� ti <br /> ��L �G�' RESOLUTION OF THE CITY COUNCIL <br /> `9kEST�IOg' N0. cC3 O � � <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.22 SUBDIVISION 1B <br /> FILE NO. 02-2809A <br /> WHEREAS, Rick Sterling & Kristine Sterling, husband and wife, <br /> (hereinafter "the applicants") are the owners of the property located at 1300 Vine Place <br /> within the City of Orono (hereinafter the"Cit�') and legally described as follows: <br /> . Tract B, except the easterly 35 feet thereof parallel with and measured at a right <br /> angle to the easterly line of said Tract B: Tract C, and Tract D, except the <br /> southerly 28 feet parallel with and measured at right angles to the southerly line of <br /> said Tract D, all in Registered Land Survey No. 488, files of Registrar of Titles, <br /> • Hennepin County,Minnesota. <br /> (hereinafter the"property"); and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 10.22, Subdivision 1B to allow <br /> the construction of a deck addition encroaching 105' past the average lakeshore setback. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono,Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#02-2809A. <br /> 2. The property is located in the LR-1B Lakeshore Residential Zoning <br /> District, which requires an average lakeshore setback of 75 feet and no <br /> closer to the lakeshore than the average distance from the shoreline of <br /> existing residence building on adj acent lots. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on July 21, 2003 and recommended approval of the average lakeshore <br /> setback variance based on the following findings: <br /> � <br /> Page 1 of 5 <br />
