Ordinance No. 9.28 and 9.21 <br />ISSUE - <br />1. Presentation of strategy to deal with large parties by <br />underage individuals. <br />2. Adoption of one element to help deal with the problem. <br />INTRODUCTION - The police department has been frustrated in their <br />e{torts over the years to deal with parties in which there are <br />large numbers of often underaged individuals who are engaged in <br />alcohol consumption. Part of the problem revolves around: <br />1. The fact that unless there is probable cause the <br />officer is not able to enter the premises, even with a <br />search warrant. <br />2. It is often difficult to prove consumption of <br />alcoholic beverages by minors. <br />3. That there have seen situations where parents have <br />actually been home when consumption has been taking <br />place and either claim that they are unaware of it or <br />that they thought that it was legal to undertake such <br />when the minors parents were not present. <br />DISCUSSION - The objectives that the police department is trying <br />to Wfifeve eventually in a comprehensive manner is to: <br />a. Appropriately respond to complaints of noisy parties and where <br />appropriate, break those up. <br />b. Reduce the opportunities for consumption of alcohol by minors <br />in large gatherings. <br />C. Limit the number of intoxicated drivers, particularly those <br />under age. <br />As noted in Attachment B the first means to get at this is to put <br />a more definitive noise policy in the ordinance. Presently under <br />Ordinance section 9.24 there is only very general language <br />
