F <br />Zoning File #1296 <br />June 17, 1988 <br />Page 6 of 6 <br />Alternatives for Planning Commission Action <br />If you approve the request of the applicant and allow the existing dock to <br />remain, staff would suggest the following conditions: <br />1. The current owner of Tracts 9, 10, 11 and 12 must transfer all <br />interest to applicants and applicants must legally combine all six <br />parcels. <br />J 2. Mr. Gustafson must also provide l.gal access to the dock area via <br />0003. <br />3. Dock limited to two slips only - it should be added that this <br />property has a Grandfather status, per LMCD codes and the dock would <br />be allowed without the principal structure. <br />4. No parking shall be allowed on the county road. <br />5. No other structures can be installed on the property. <br />6. No defin^d parking area with gravel or blacktop can be installed <br />on the property. <br />If denied, the following conditions should be considered: <br />1. Immediate removal of the dock. <br />2. Applicant can use the subject property for picnic purposes, <br />i <br />mooring of a boat on the shoreline, but not kept there permanent?.y. <br />3. Access to the site must be via parcel 003. Gustafson, the <br />current owner, must provide access easement for applicants. <br />How does Planning Commission wish to address the fact that Mr. Tillotsen's <br />dock is also located on Tract F. What plans does Mr. Gustafson have for <br />Tracts B, C, D and E? <br />Additional Comments and Planning Commission commendation <br />July 7, 1989 <br />Additional Exhibits <br />Exhibit M - Planning Commission Action Notice <br />The applicants were encouraged to submit additional information in <br />support of their request (review Exhibit M) but have failed to do so. The <br />Gustafsons, the owners of RLS 1216 and Parcel 0003, have failed to contact <br />the City throughout the review although they were sent a copy of the staff <br />memo prior to the Planning Commission meeting and a copy of the Planning <br />Commission Action Notice after the meeting. Mr. Tillotsen called staff <br />prior to the meeting to advise that he would like to purchase the portion <br />of Parcel 0003 that his house and driveway encroach as that was all he <br />could afford. When asked to comment on the fact that his dock was on Tract <br />F, Mr. Tillotsen advised that the Gustofsons had always allowed him tj <br />locate his dock at that location to facilitate navigation through the <br />channel to the main lake. <br />
