14. <br />MIIJUTES OF THE REGULAR ORONO COUNCIL MELTINC. â–ºIELD JULY B. 1985. PAGE 6 <br />'WA.RD E . EDWAitDS <br />2474 CARMAN STREET <br />VARIANCE <br />RESOLUTION <br />Mr. ward E. Edwards was present. City Administrator <br />Bernhardson explained the issues of the applicants request <br />to build a residence on his lot which is divided by a lagoon. <br />The first issue is the crediting of hardcover from the land <br />north of the lagoon, and secondly, the building of the <br />residence 50'from the lake. Bernhardson noted that the two <br />adjacent neighbors have indicated they prefer the residence <br />to conform with their homes, which would be within the 75' <br />setback. <br />Asst. Zoning Administrator Caffron indicated that there is <br />approximately .70 acre in the south portion of the lot and 1 . 0 <br />acre in the north portion. The lot is zoned one acre. <br />Mayor Butler expressed concern that some restriction be made <br />in taking credit of the north portion in order to prevent a <br />future request to subdivide the lot. <br />Because of the serious concern of a future subdivision, it <br />was moved by Mayor Butler, seconded by Councilmember Frahm, <br />to approve the conceptual concept of the lakeshore setback <br />and direct staff to re -draft the Resolution incorporating <br />the Councils' concerns addressing the hardcover in the north <br />f portion of lot. Motion, Ayes (5), Nays (0). <br />i933 VED BUTTERFIELD <br />3745 WATERTOW'N ROAD <br />COVVITI011AL USE PERMIT <br />RESOLUTION 11793 <br />City Administrator Bernhardson stated that Mr. Butterfield <br />was not able to attend because cf illness and has requested <br />Council to proceed with his request. Bernhardson further <br />stated applicants request to construct a new 401x100' <br />greenhouse on a 4.6 acre lot zoned 5 acre. A new conditional <br />use permit is required to allow this construction. <br />Bernhardson recommends that because it is a substandard lot, <br />the Conditional 'Jse Permit be granted conditioned upon no <br />further additions or greenhouses are built. <br />Councilmember Frahm recommended that Condition 15 be added <br />to the drafted resolution stating that "Tbe retail sale of <br />flowers on the property will cease". <br />It was moved by Councilmember Frahm, seconded by <br />Councilmember Nammerel, to approve Resolout-on 41793 <br />subject to the two conditions as previously stated.
