The granting of the proposed variance will not in any way impair <br />health, safety, comfort, morals, or in any other respect be contrary <br />to the intent of the zoning code. Development on extremely <br />substandard lots which have other reasonable uses is not in keeping <br />with the intent of the Zoning Code. <br />8. The granting of such variance will not merely serve as conlrevience <br />to the applicant, but is necessary to alleviate a demonstrable <br />hardship or difficulty. Has a hardship been demonstrated? <br />Staff Recommendation <br />Staid feels there are persuasive arguements on both sides of t 4sue. <br />Taking what can only be considered as a very conservative viewpc staff <br />would recommend denial of the variances on the basis that adding another <br />house to this densely developed neighborhood will not be in keeping witb <br />the spirit and intent of the LR-18 zoning district,and the granting of the <br />lot area and lot width variances will ultimately lead to requests for <br />variances to average lakeshore setback and hardcover requireseents, and will <br />ultimately have a negative impact on the character of the neighborhood as <br />well as have a negative impact on the quality of water in Lake Minnetonka. <br />The applicant has a reasonable use of the property as a side yard area <br />which he has maintained as part of his principal residence for more than 10 <br />years. <br />
