Bumgardner <br />9201 Cain Road <br />Corcoran, MN 55340 <br />Re: Property at 3800 Wayzata Boulevard, Orono <br />Dean Mr. Bumgardner: <br />This letter is written to you as the last confirmed owner of the above <br />referenced property. Staff has received recent information via an informal <br />phone *;onversation with a representative of the David C. Bell Investment <br />Company, that the investment company had purchased the property for the <br />purriose of leasing. If this is the case, a copy of this letter has also <br />been sent to the David C. Bell Company. <br />It is important that the _wner of the property be made aware of the <br />limitatic; - of the commercial use of the property currently zoned RR-lB, <br />Rural Residential (unsewered). <br />The grocery/speciality food store use is recognized as a legal non- <br />conforming use, a use that has existed on the site under multiple leasers <br />and/or owners for over 30+ years. If the legal non -conforming use is <br />discontinued for one year, the use of the property must revert back to a <br />conforming residential use. The Summerfield Market was closed to the <br />public on approximately June 15, 1987 (June 7th or June 8th). If it is the <br />intent of the new owner to continue the grocery store use, a conditional <br />use permit must be filed with the City of Orono by April 22nd, 1986. <br />Staff has enclosed specific sections of the RR-1B zoning district that <br />deal with permitted uses (approved accessory uses or conditional uses). In <br />addition, we have enclosed copies of previous resolutions approved by the <br />Orono Council for the grocery/speciality food shop use that will prcvide <br />background on the unique physical limitation of the property and the <br />limitations on that use. If the present owner wishes tc install a less <br />i.tense, new commercial use of the residential proper'._y, the applicant <br />would have to file a land use application by that same April 22nd, 11)88 <br />deadline date.
