Note the only change that staff would <br />call attention to was a change required by the building inspector with the <br />review of the building plans, review Exhibits I and J. A fire exit was <br />required in the area established for the expanded office area. Staff would <br />recommend approval of the modified floor plan as shown on Exhibit J. <br />Mr. Kirt has not submitted the name of the manager of the store, but it is <br />staff's understanding that it will be an individual who was to operate the <br />delicatessen/catering service under Mr. Bumgardner's ownership. For this <br />current review, staff would also suggest that the current owner review the <br />conditions of approval set forth in Resolution 1735 that first approved the <br />delicatessen/catering use for the property, specifically 1 through 4 found <br />on page 3 of that resolution that states the following: <br />1. All equipment installed to support the mini -bake operation is <br />subject to the standards of the uniform building code and fire code. <br />2. Prior to installing the delicatessen use, the applicants must <br />obtain a license from the Hennepin County Community Health Department <br />for the food preparation operation. <br />3. All foods consumed at informal outdoor picnic area mus: be <br />purchased at retail from within market. <br />4. Food shall not be served for immediate consumption either on the <br />premises or in the form of take out resturant. <br />It is most important that the current owner realize that there were <br />definite limitations as to the approved delicatessen/catering use for the <br />property. There were to be no indoor tables for consumption on the <br />premises. The owner/applicant is allowed a single outdoor picnic table for <br />the hikers use from the near by Baker Park Reserve hiking trails. <br />Staff Recommendation <br />Based on the directives of Resolutions 1377, 1646, 1735, and 2188 staff <br />would recommend the following guidelines for the limits on the continued <br />commercial use of the residential zoned property located at 3800 Wayzata <br />Boulevard. <br />1. All conditions as itemized in Resolution 2188 lA through M. <br />2. To permit a mini -bake and limited delicatessen/catering service <br />for pick-up retail use only. Immediate consumtt.ion on the premises of <br />such products is not permitted. <br />3. one picric table to he 1.1aced within the 2f" by 25' designated <br />outdoor sal^ area at the east side of market. <br />4. Approval of all interior alterations as discribed in Exhibit J of <br />the Planning Commission packet submitted for the June 6, 1988 meeting. <br />5. Prior to reopening the business to the tublic the applicant/owner <br />or their contractors shall obtain all required permits to complete the <br />reconstruction of the interior of the structure. <br />6. The applicant/owner must obtain a license from the Hennetir <br />County Community Health Department for the food pretarati.on operation <br />prior to the opening of the market. <br />7. The applicant/owner is hereby advised that all conditions set <br />forth in the previous resolutions that defined and limited the <br />commercial use of this residential property are still in effect and <br />any violation of these conditions of operation may result in the <br />tossihle revocation of the current Conditional Use Permit. <br />
