2. To permit a mini -bake and limited delicatessen/catering <br />service for pick-up retail use only. Immediate consumption <br />on the premises of such products is not permitted. <br />3. To allow one picnic table to be placed within the 20 x 25 <br />designated out door sales area to the east side of the <br />market. <br />4. Approval of all "incidental alterations" as described in <br />the floor plan approved with this conditional use permit and <br />included with this resolutior as page 8. <br />5. Prior to re -opening the business to the public the <br />applicant/owner or their contractors shall obtain all <br />required permits to complete the re -construction of the <br />interior of the structure. <br />6. The applicant/owner must obtain a license from the <br />Hennepin County Community Health Department for the food <br />preparation operation prior to the opening of the market. <br />7. The new owner is hereby notified that the City Council <br />will not consider any future building construction, additions <br />or expansion for commercial uses because to do so would <br />extend or intensify the non -conforming use contrary to the <br />intent of the zoning code and contrary to the intent <br />of. the Comprehensive Community Management Plan. This <br />provision does not preclude normal building maintenance, <br />repair or incidental alterations necessary to continue the <br />non -conforming use within the existing structure as permitted <br />by the terms of this Resolution and Orono Re;olur_ion No. <br />1377. <br />B. The applicant agrees that he has no vested property <br />rights to continue commercial use of the premises except in <br />strict accordance with the terms and conditions of this <br />Resolution and Orono Resolution No. 1377, and the City mry <br />impose additional conditions as may be needed in the future <br />in order to protect the public, safety and welfare. <br />Applicant further agrees to waive any rights to object to <br />such other conditions if after a complete and full hearing <br />the City Council determines that such condition is necessary <br />to protect the public health, safety and welfare. <br />Page 5 of 10 <br />
