MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JUNE 13, 1988 <br />COUNCIIJCDIBER SELECTION PROCESS CONTINUED <br />It was moved by Acting Mayor Callahan, seconded by <br />Councilmember Peterson, that the Orono Council <br />acknowledge the informa'.ion regarding the selection <br />process, set 1 July as the dead l ine date, and that <br />Council concur with the drRft letter to be sent to all <br />applicants in advance of the interview on 11 July 1988. <br />Motion, Ayes 4, Nays 0. <br />CITY ADMINISTRATJR'S REPORT: <br />RMQOEBT FOR ORDINANCE AMENDMENT <br />-SOLICITOR'S ORDINANCE <br />City Administrator Bernhardson explained the request <br />from Paul Larson to amend the solicitor's ordinance as <br />it relates to requiring to place solicitation on <br />commercially zoned property. Staff recommends that the <br />current language and ordinance be retained. He noted <br />that Mr. Larson was advised that this issue would by on <br />this agenda, but Mr. Larson -as not present. <br />It was moved by Councilmember Sime, seconder'. by <br />Acting Mayor Callahan, to table this matter for staff to <br />contact Mr. Larson requesting his presence. Motion, <br />Ayes 4, Nays 0. <br />RMQOMST FOR ORDINANCE AMZNDMENT <br />-ANIMAL CONTROL <br />-FENCE HEI:.HT <br />John Ho Lander was present for this matter and stated <br />that the animal control matter has been resolved. <br />City Administrator Bernhardson explained the request <br />from Mr. Hol.lander to review the current 3-1/2' high <br />fence limitations in relation to the setback areas. Mr. <br />Hollander has noted other split rail fences that have <br />been constrLeted in his neighborhood in which the posts <br />are generally 4-1/2'-5' in height and cross bars are 4'- <br />5' in height. Mr. Hollander has requested to be allowed <br />to construct a similar fence and staff has indicated to <br />him that City code does not allow such construction. <br />Mr. Hollander stated that almost every split rail fence <br />in the City is in violation of the ordinance. He <br />suggested, rather than going after all these fence <br />violations, that the Council amend the ordinance to <br />al low split rail fences to be at 4-1 /2' in height; and <br />allow him to construct a split rail fence the same as <br />his neighbors'. He stated that depending on what the <br />city does regarding the enforcement of the fence height <br />violation, and by not allow him to have the same height <br />fence as his neighbors, he may have a discriminatory <br />action against the City. <br />10 <br />
