City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO, <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono <br />City Council hereby grants a variance to Municipal Zoning Code Section <br />10.22, Subdivision 1 to permit the construction of a deck which encroaches <br />no more than 5' into the 75' required lakeshore sett, ck, and grants a <br />variance to Pections 10.22, Subdivision 2 and 10.55, Subdivision 8 to <br />permit the construction of deck and room addition which comprise additional <br />hardcover in the 0-75' and 75-250' lakeshore zones, in excess of the <br />hardcovers percentages normally allowed in those zones, subject to the <br />following conditions: <br />1. Hardcover allowed on the property is as follows: <br />0-751: (area = 63,000 s.f.) <br />House 430 s.f. <br />Deck 112 s.f. <br />Total 542 s.f. (8.68) <br />Applicant shall remove 178 s.f. of plastic from existing landscape <br />beds in the 0-75' zone, prior to final inspection of the proposed room <br />addition. <br />75-2501: (area = 15,900 s.f.) <br />House 2,436 s.f. <br />Concrete and Steps 371 s.f. <br />Shed Portion 65 s.f. <br />Driveway 2,084 s.f. <br />New Deck Portion 208 s.f. <br />New Room Addition 336 s.f. <br />Total 5,500 s.f. (34.6%) <br />Applicant shall remove the 20 s.f. of steps on the east side of the <br />house, and 280 s.f. of plastic underlaid landscaped beds in the 75- <br />250' zone, prior to final inspection of the proposed room addition. <br />2. Applicant is advised that no future hardcover will be allowed in <br />the 0-75' and 75-250' zones on this property, and that any future <br />proposal to increase hardcover on the property will not be approved, <br />but might be approved only in conjunction with removal of an <br />equivalent amount of existing hardcover, resulting in no net increase <br />in hardcover. <br />3. Authorities granted with this resolution run with the property not <br />with the applicants, but are permissive only and must be exercised by <br />application for a building permit within one year of the date of <br />Council approval, or this variance will expire on -.hat date (June 27, <br />1989). <br />Page 3 of 5 <br />
