Denial - Require complete removal of fence structure <br />within the road right-of-way of Briar Street. <br />B. Approval - Based on the findings and hardships noted in <br />applicant's letter (Exhibit C). <br />Alternatives of Action Variance Portion of Application - <br />A. Approval of privacy fence less than 6' in height along <br />the north and south boundaries of property as proposed by <br />applicant. Depending upon Council's decision concerning the <br />appeals portion of the application, applicant may request <br />relocating fence along the street yard within the confines <br />of private property. Applicant should he further advised <br />that the approval of this height variance wiI I expire one <br />year from the date of original variance approval (September <br />25, 1990). <br />B. Denial. Permitting only a 3h' height fence around the <br />boundaries of the property and advising that additional <br />plantings may provide the necessary additional buffer to <br />pool area. <br />Council Action - <br />To provide conceptial direction to staff so that an <br />appropriate amendment of the original conditional use <br />permit/variance application can be prepared for the January 8, <br />1990 meeting of the Council. <br />
