• <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants variances to Municipal Zoning Code <br />Section 10.28, Subdivision 5 (B) and Section 10.75, Subdivision <br />4 (B), and grants a conditional use permit per Section 10.03, <br />Subdivision 10, to allow the installation of a pool on a through <br />lot to be placed 24'9" from the rear street lot line instead of <br />50' and a rear addition to the principal structure that will be <br />located 19' From the north side lot line instead of 30', subject <br />to the followinq conditions: <br />1. Per Section 10.03, Subdivision 4 (C) the applicant and/or <br />future owner is placed on notice that if a fence of 6' or <br />greater is installed around the pool, such improvement would <br />require variance approval fror,� the City of Orono. <br />2. Authorities granted by this resolution run with the <br />property not with the applicant, but are uermissive only and <br />• must be exercised by application for a building permit for <br />the retaining walls within one year of the date of Council <br />approval, or the special conditions of this resolutir.�n will <br />expire on that date (September 25, 1990). <br />3. Violation of or non-compliance with any of the terms and <br />conditions of this resolution shall constitute a violation <br />of the zoning code, shall automatically terminate: any <br />authority granted herein, and shall be punishable as a <br />misdemeanor. <br />4. The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on behalf <br />of himself, his heirs, successors and assigns, hereby agrees <br />to the recording of this resolution in the chain of title of <br />the property. <br />Page 3 of 5 <br />L� <br />
