City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.24, SUBDIVISION 5(B) - <br />FILE #1272 <br />WHEREAS, Richard J. Heit (hereinafter "the applicant") is <br />owner of the property located at 1153 Elmwood Avenue within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Lots 8 and 19, Skarp and Lindquists Fernhi l 1, according to <br />the recorded plat thereof, Hennep=n County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Sections 10.22, Subdivision 2 and <br />10.24, Subdivision 5(B) to permit the construction of a second story <br />addition which will comprise additional structural hardcover in excess <br />of the 25% hardcover normally allowed in the 75-250' lakeshore setback <br />zone, and which will be located less than the required 10.0' " nm the <br />side lot line. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File 01272. <br />2. The property is located in the LR 1B Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Cemmissior reviewed this application on <br />May 16, 1988, and recommended approv Df the proposed vuricnces <br />based upon the following findings: <br />a) The percentage of hardcover in the 75-250' zone will not <br />increase from its existing 44.5%. <br />b) The proposed addition wi 1 1 have no impact on the views of <br />the lake enjoyed by any neighboring property. <br />Page 1 of 5 <br />
