Public Hearing <br />ISSUE <br />1. Acknowledgment of information regarding agreement between the <br />City of Orono/Woodhill Country Club and M.C.M. Associates <br />regarding their share of costs related to the upgrade of Woodhill <br />Avenue. <br />2. establishment of the public hearing date for the special <br />assessment hearing for the upgrade of I•;oodhill Avenue. <br />INTRODUCTION - As you c.al recall a contingency of the final <br />T <br />subdiT-vTi_si_on-n- Eor McDowell passed on September 28, 1987 was that <br />they were to enter into an agreement regarding their fair share <br />of costs for the upgrade of Woodhill Avenue. Bayed on th.� <br />agreement the parties have closeu tneir land sale on Monday, <br />October 5, 1987. <br />DISCUSSION - After a review of the project it was doterr;:ink2d by <br />stafflChaC the appropriate share between Woodhill Country Club <br />and John McDowell was a total of 75% of the total cost of the <br />upgrade. Between the parties they agreed that Woodhill would <br />share 3/16 of the price and McDowell would ':hare 9/16 of the <br />price. This represents a waiver of the special assessment. <br />In order to get this upgrade pr,)ject under way for construction <br />in the spring of 1988 it is necessary that a public hearing be <br />scheduled and suggest the Novei7ber 23, 1987 Council meeting at <br />which time the other three ben. -fitting property owners can <br />present a case and at which time the Council can determine their <br />appropriate share for the upgrade. Fused on the 75% that has <br />been agreed to by McDowell the staff.f's recommendation that the <br />City fund 103 of the cost (approximately $6,200 maximum) which is <br />its foregone share of the maintenance over a 20 year period and <br />up to the balance of 15% be assessed over the other three <br />property owners based on the amount of frontage they have on <br />Woodhill Avenue. Should Woodhill have to begin to use this, as <br />their primary access it would require further upgrade of woodhill <br />Avenue which would by necessity need to be borne by the Country <br />Club. <br />
