At this time, the <br />applicant is the fee owner of the property located in the residential zone. <br />The location of this structure is also in conflict with 10.41, Subdivision <br />9 (B) - Side yard setback which is 101. <br />Required Existing Proposed Variance <br />10' 14' 9' 1' 10% <br />9.) Lot Area, Lot Width Lot area required in this B-2 zoning district is <br />2 acres (87,120 s.f.). <br />The property which exists within the B-2 district is 37,400 s.f. (.85 <br />acre). The variance is as follows: <br />Required Existing Variance <br />87,120 s.f. (2 acres) 37,400 s.f. Applicant is <br />requesting a variance to this section, due to the parking requiremtns, size <br />of the structure and size of the lot. <br />During the last Planning Meeting applicant attended, the Planning <br />Commission recommended that landscaping variance not be approved for the <br />10' required in front of the building. Applicant has provided the 10' of <br />landscaping, but still requests the variance for the landscaping required <br />in front of the parking lot on both sides of the county road. Requirements <br />are as follows: <br />Existing Required Proposed Variance <br />60' Max. 50' 60' 10' 20% <br />Applicant is requesting this variance because of the parking requirements. <br />To meet this requirement, applicant would lose 4 parking spaces. <br />Applicant is also requesting a 1' variance on the north side of the <br />structure. <br />Staff recommends approval based on the following findings: <br />1. Hardcover reduction of 8,759 s.f. <br />2. Area on Browns Bay Side will be a more private use by the public <br />which rents boat slips. <br />3. Less intense use of property with removal of storage building on <br />Browns bay Side. <br />4. Access will be defined with curbing on both areas <br />5.) Better control of drainage. <br />
