the developer of that land will provide recreational amenities <br /> which would significantly reduce the demands for public recrea- <br /> tional facilities to serve that development, such as swimming <br /> pools, tennis courts, playgrounds and the like, then in the <br /> sole discretion of the City Council, the amount of land dedi- <br /> cated or cash equivalent may be reduced by an amount not to <br /> exceed 250 of the amounts stated above. <br /> (b) Timing of Calculation and Payment of Charges. <br /> The requirements of this ordinance when applied to residential <br /> developments shall be imposed at the time of the approval of the <br /> subdivision, division or replat, or if the land has already been <br /> subdivided and the charge has not been paid pursuant to this <br /> ordinance, at the time of the issuance of a building permit for <br /> a primary structure. The ordinance shall apply to all subdivi- <br /> sions coming within the definition provided in Chapter 39, as <br /> amended. Any land that is further subdivided, divided, or <br /> replatted subsequent to the imposition of the requirements of <br /> this ordinance, shall be subject to the requ�xeme�ts o� the <br /> ordinance then in effect concerning dedicat�4n of l�nd �or <br /> recreational purposes. <br /> (c) Charges when Variance Requested. When an <br /> application for a variance rom the platting provisions of the <br /> subdivision ordinance is considered, or upon receipt of an appli- <br /> cation for division or replat of land which does nat come within <br /> the definition of a subdivision in Chapter 39, as amended, if <br /> the City Council finds that the requested subdivision, division <br /> or replat could reasonably be deemed to preclude the future plat- <br /> ting of such land or parts thereof, the council may calculate and <br /> require the appropriate amount of land, or cash in lieu of land, <br /> to be dedicated ta the city for park, playground and recreational <br /> purposes in accordance with the provisions of this ordinance. <br /> (d) Dedication Not Required. Dedication will <br /> not be required for any combination o lots into one lot on which <br /> there is a dwelling unit already existing nor for any alterations <br /> of existing lot lines which alterations do not result in an increase <br /> of the number of building sites. <br /> Section 2. This ordinance shall be published in the Orono <br /> Sun and shall be effective upon publication. <br /> Passed by the Orono Council this 8th day of March, 1976, by a vote <br /> of 4 ayes and 0 nays. <br /> Robert .
