Notification under this <br /> chapter sha21 be made in writing to the owner of the dock or wharf <br /> at the address given in the applicatian. Failure to have a valid <br /> license in force shall be prima facie evidence of a vialation of <br /> this Ordinance. � <br /> - 73. 070. Factors to be Considered in Grantin or Denyin <br /> Licenses. As the use of La�e Minnetan a y Orono resi ents an <br /> . others or boating, fishing, swimming, °�ater skiing, and other uses <br /> continues to increase each year, the Cauncil is faced with increasing <br /> � �roblems �n lacensing af cam��ercial �ock�. Th� Council �eca�:izes <br /> that the interests of lakeshare residents are to some extentrin <br /> conflict with the interests of persons in the business of operating <br /> � commercial docks, and the Council is mindful of frequent complaints <br /> as to the extent and manner of commerciai dock operations. The <br /> Council finds that, as lake use increases , licensing proc�dures <br /> and standards which have been adequate in the past have become in- <br /> adequate a�d the danger to tr.e public health, safety, and welfare has <br /> increased greatly. In determining, theref�re, whether or not a <br /> license shaii be g�anted under this chapter, the Council may establish <br /> d�-�:.: -.--t�i :�'.-: _,L1C1'3 OI '�`e@ i�.,t.ttJW1F':� r'�_^.'.111"�?'ClEI'lt`S c"�.P![� rPer�il ati nnc ths?ra�nr <br /> as it deems in the best interest of the City so as toJpromote public <br /> safety, health, welfare, and sanitation in the use or the lake, <br /> eliminate extreme congestion on the lake (which reduces the er�joyment <br /> of all� , restrict excessive noise, pollution, and fumes, eiiminate <br /> . � unsightly installations or accumul.ations visible eitherr. from the lake <br /> or from the shore, and eliminate road and parking congestion. <br /> (l� The maximum number of boat slips on the land <br /> and on the water and boat buaYs -that may �e constructed <br /> may be regulat�d for each licensee. In setting such <br /> maximum the Council may have in mind the size of the bay <br /> on which the installation is loc�tedr the congestion of <br /> boat traffic on said bayy t:le other licenses expected on <br /> said bay, the character of the property and adjacent <br /> properties, the proposed number of boat slips on the <br /> land and on the water and boat buoys , and any other <br /> �actors which it deems relevant. The number o� boat <br /> � slips and boat buoys allowed shall include any space <br /> used or intended to be used for the persanal use of the <br /> � licensee and his family or friends when located on or <br /> a.djacent to the premises from, which the licensee ir.tends <br /> to conduct the business. <br /> - _ {2� Off-street parking facilities may be required in <br /> such extent as the Co�ncil may feel necessary to eZiminate <br /> any traffic or parking congestion likely to be caused by <br /> the ausiness of the licensee. <br />
