7. Consideration. City shall sell the City Property to <br />Messer for the consideration of One Thousand Five -Hundred Dollars <br />($1,500.00) plus all legal and abstracting fees incurred by the <br />City relating to this sale. All recording, registration and <br />related fees shall be paid by Messer. Payment of the purchase <br />price and all legal and abstracting fees shall be made to the <br />City at the date of closing, which date is outlined below. <br />Payment shall be in the form of a cashier's or certified check <br />made payable to the City of Orono. City shall inform Messer five <br />(5) days prior to the closing date of the amount of legal and <br />abstracting fees it has incurred which will become a portion of <br />the payment for this transaction. <br />S. Soil. Messer understands the City makes no <br />representation as to the quality or substance of soils sub -grade <br />material, or ground water existing within the City Property. <br />City has no knowledge of any hazardous substances which may have <br />been placed upon or within the property prior to or during the <br />City's ownership of the City Property. As used herein, <br />"hazardous substances" means any substances, waste, pollutant or <br />contaminant now or hereafter included within such terms under any <br />federal, state or local statute, ordinance, code or regulation <br />now existing or hereafter enacted or amended. <br />9. Access. The parties acknowledge that the City Property <br />abuts not only the Messer property to the South, but also abuts <br />Lots 1-4 of Pheasant Lawn to the North ("Adjacent Property").
