PURCHASE AGREEMENT <br />THIS AGREEMENT iu made and entered into on the _ day of <br />, 1988 by and between Dallas C. Messer and Virginia <br />G. Messer, husband and wife, their heirs, successors and assigns <br />(hereinafter referred to as "Messer") and City of Orono, a <br />Minnesota Municipal Corporation, its successors and assigns <br />(hereinafter referred to as "City"). <br />1. Currently, City is the owner of property located in <br />Hennepin County, Minnesota legally described as: <br />That part of Lot Five (5) lying Northerly of a line <br />drawn parallel to, and forty (40) feet distant southerly <br />from the Northerly line of said Lot Five (5), "Pheasant <br />Lawn", according to the plat thereof on file and of <br />record in the Office of the Registrar of Titles in and <br />for said Hennepin County, State of Minnesota. <br />Subject to covenants and restrictions, etc. as contained <br />in deed Doc. No. 209388. <br />(hereinafter referred to "City Property".) <br />2. Messer is the owner of property located in Hennepin <br />County legally described as: <br />Lot 5, "Pheasant Lawn", except for that part of Lot 5, <br />lying Northerly of a line drawn parallel to and forty <br />(40) feet distant Southerly from the Northerly line of <br />said Lot 5, "Pheasant Lawn." <br />(hereinafter referred to as "Messer Property".) <br />3. Messer wishes to purchase, and the City agrees to sell, <br />the City Property under the specific terms and conditions within <br />this Purchase agreement. <br />
