Gerhardson r <br />Re: 1950 Shoreline Drive <br />/\ Orono, Minnesota \l) <br />Dear Mr. Gerhardson:" <br />- <br />I have been retained by Gerald Toberman to respond to the <br />resolution passed by the City of Orono on October 26, 1987, and <br />to answer staff's follow-up correspondence in this regard. This <br />correspondence will also serve to negate the January 11, 1988, <br />letter sent to the City of Orono by Venl Larsen, property manager <br />for Mr. Toberman. Mr. Larsen and Mr. Toberman were operating <br />under an incorrect assumption of facts and law when the January <br />11, 1988; correspondence was prepared. <br />Mr. Toberman specifically denies that the two cabins on the <br />property at 1950 Shoreline Drive are in a hazardous or dangerous <br />condition. There is no health hazard and there is no seepage or <br />leaking from the sewage tanks used by the cabins. <br />With regard to the other alleged repairs that are necessary <br />to bring the cabins into habitable condition, Mr. Toberman <br />intends to have someone inspect the structures and he intends to <br />place them into habitable condltiur. <br />The Stipulatlun entered into by the previous homeowner end <br />the City of Orono did call for the hook-up of two sewer units to <br />the main structure on the property. The agreement, however, did <br />not indicate that the cabins would be destroyed, nor did it <br />contemplate that they would cease to be used for rental units. <br />Quite the contrary, the cabins remain non -conforming struc-ures <br />and, so long they can be used in a safe and healthy manner, the <br />property owner must be permitted to use them. <br />
