Providing the Council with updated information and actions in <br />relation to the above listed property. <br />2. Providing the Council with the opportunity to direct further <br />action in this matter. <br />INTRODUCTION -As the Council has been aware, this property has <br />been the subject of several City contacts since 1982. The <br />resieent has continued to violate selected City ordinances and <br />accoriing to the neighbors is an aggravation to them. <br />DISCUSSION_ - In 1987 the Council following due process was ready <br />to_revoke_ the gentleman's temporary certificate of occupancy and <br />had undertaken hazardous buildings proceedings. The owner at <br />that point decided to cooperate with the City and make the <br />necessary repairs to his house, which were primarily foundation <br />problems, which he did by raising his house up 6 feet and <br />installing a 6 foot high exposed foundation wall. As he had <br />drawn a permit and the work continued and is now mostly complete <br />the City was not in a position to deny him his right to undertake <br />this work. As noted in Attachment A the City did undertake in <br />the response to complaints; a review of vehicles on the property <br />and did cite Mr. Henke for violations of selected statutes, this <br />went to Court in March and Mr. Henke was given a suspended one <br />year sentence predicated on no further violations. In response <br />to complaints the week of May 2 the City again reviewed the <br />property on the 9th and has further cited Mr. Henke regarding <br />this. Currently the City is awaiting review of this matter by <br />the Prosecuter to see not only what effect this has in <br />relationship to the current citations but also what impact it has <br />on the suspended one year sentence. <br />The City is attempting to review, as time permits, the <br />possibility of the occupant of this address running a used car <br />business from that site. <br />There are however certain aggravations to the neighbors by this <br />property owner that the City is not presently able to do anything <br />about . <br />
