No attachment to the left side of the house is feasible due to <br />the location of the existing septic system; additionally, this would <br />require a major revision of the driveway location which would start to <br />encroach into the area needed for replacement of the septic system. <br />The existing septic system on this property was found to be failing in <br />1"33. A permit was issued for the replacement of that system in 1984, but <br />the work has never been completed. The system has been functioning <br />marginally since that time, however, since that system still has a high <br />potential for failure it should be replaced. <br />An argument could be made that because the lot sizes in this area are <br />around 1 acre, that the neighborhood property owners' expectations are not <br />necessarily as strict regarding setbacks as if this had been developed at a <br />2 acre density. In Orono's 1 acre zones, only a 10' side setback is <br />required. Absent any opposition from the affected neighbor, it would not <br />seem inappropriate to allow the 21' setback proposed. <br />Staff Recow ndation <br />Staff recommends approval of the side setback variance to allow the <br />attached garage to be constructed 21' from the side lot line, finding that <br />the proposed garage location is the most appropriate given existing <br />development on the site, and given that there will be no significant <br />encroachment of light, air, or open space enjoyed by the neighboring <br />affected property. <br />'. i -M 6 } f-L ' i <br />
