City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />VARIANCES '170 <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTIOR 10.55, SUBDIVISION 8 <br />AND COMnITIONAL USE PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #1273 <br />WHEREAS, Rollin and Sharon Lacy (hereinafter "the applicants") <br />are the owners of the propertv located at 2655 North Shore Drive within the <br />City of Orono (hereinafter "City") and legally described as follows: <br />That part of Government Lot 4, Section 9-117-23 described as follows: <br />commencing at a point in the center line of County Road 15 as laid out <br />and traveled in the eastly and westly direction across said tract, <br />which point is 825.35' eastly from a point where the center line of <br />said roa3 intersects the western line of said Government Lot 4; <br />thence at right angles to said center line of said county road a <br />distance of 382.121 more or less to the shores of Lake Minnetonka; <br />thence eastly along the shore of said lake 210' to a point in the <br />center line of so called side road leading from county road aforesaid <br />to said lake; thence northeasterly along the center line of said side <br />road a distance of 385' more or less to a point of the center line of <br />aforesaid county road; thence westerly along the center line of said <br />county road a distance of 270' to the point of beginning according to <br />the plat thereof on file or of record in the office of the county <br />recorder, Hennepin County, Minnesota (description per document number <br />4753759), (hereinafter "property"); and <br />WHEREAS, the applicant has ms.de application to the City of Orono <br />to permit the filling of approximately 250 cubic yards of fill within 75' <br />of the shoreline of Lake Minneto %a where no filling is allowed per Section <br />10.22, Subdivision 2 and Section .10.55, Subdivision 8 and a Conditional Use <br />Permit for the proposed land alteration that exceeds 100 cubic yards of <br />fill per Section 10.03, Subdivision 19. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1.
