• • <br /> Revision 12-14-11 <br /> 9. FUTURE SERVICE TO CATEGORY 3 PROPERTIES. The Category 3 <br /> properties if redeveloped for residential use at the low-medium density for which they are guided <br /> within the Orono 2008-2030 Comprehensive Plan, could result in 15-25 additional future <br /> connections to the Long Lake sewer and water systems. Long Lake agrees to provide sewer and <br /> water service for up to 25 residential sewer and water connections within the Category 3 properties <br /> under the terms provided for in paragraphs (5.) and (7.) above. <br /> 10. REGULATION OF USE. Orono agrees to regulate and control the use of the <br /> sanitary sewer system within Orono so as to prevent the discharge of waste or any storm water, <br /> surface water, ground water, roof runoff, or subsurface drainage into the sewer system that is in <br /> violation of Long Lake City Ordinances, as such may be amended from time-to-time. In case of <br /> any continuing violations of such ordinances after reasonable notice, Long Lake shall have the <br /> option to terminate this Agreement per the provisions of Paragraph 16 of this Agreement. <br /> 11. LIABILITY; INDEMNIFICATION. Each party to this Agreement shall be liable <br /> for the acts of their own officers, employees and agents and the results thereof to the extent <br /> authorized by law and shall not be responsible for the acts of the other party, its officers; employees <br /> and/or agents. Liability and damages arising from the Cities' acts and omissions are governed by <br /> the provisions of the Minnesota Tort Claims Act,Minnesota Statutes, Chapter 466, the Minnesota <br /> Tort Claims Act, Section 471.59, and other applicable law. Each party warrants that they have an <br /> insurance or self-insurance program and that each has minimum coverage consistent with the <br /> liability limits contained in Chapter 466. This Agreement does not constitute a waiver by either <br /> party of limitations on liability provided by Chapter 466 or other applicable law. This clause will <br /> not be construed to bar any legal remedies that each party may have for the other party's failure to • <br /> fulfill its obligations under this Agreement. Each party shall defend, indemnify and hold the other <br /> party harmless from any and all liability, on account of injury to persons or damage to property <br /> occasioned by the alleged negligent or intentional acts of the indemnifying party. Neither party <br /> shall be indemnified for losses or claims occasioned by its own negligence or intentional acts. <br /> 12. AMENDMENTS. This Agreement may be amended to provide for additional <br /> connections to Long Lake's water and sanitary sewer systems by written agreement between the <br /> Cities. <br /> 13. NOTICES.
