3. The delineated non-City protected wetlands on the survey be documented via a notification <br />to be filed in the chain of title. The wetland delineation will be kept on file for this property <br />for future reference. <br />4. The grading plan must be revised to eliminate any fill within 26' of the delineated wetlands. <br />5. Property owner shall be advised that the Orono zoning ordinance requires lighting in all <br />instances to be diffused or directed away from property lines in R Districts. <br />Planning Commission considered the following issues in relation to construction of the tennis court <br />and land alteration: <br />1. Wetlands/Septic. The property was subdivided in 1983 prior to Wetland Conservation Act <br />(WCA) regulations, and Orono took a Conservation & Flowage Easement over portions of the <br />property deemed to be wetland at that time. The new delineation performed under the more recent <br />WCA rules shows that areas now defined as wetland are more extensive on the site than those <br />protected in 1983. In some locations the delineation shows wetlands that weren't included in the <br />1983 easement; in other locations, areas protected by the easement are not now considered as <br />wetland. <br />This property is serviced by an on-site septic system. Staff has reviewed the existing septic system <br />and it is not directly affected by the proposed tennis court construction. The area being used for <br />tennis court would likely not be suitable for a future septic site due to its proximity less than 75' to <br />the wetland. <br />Due to potential impacts on drainfield sites the Planning Commission felt additional protection <br />measures be put in place that will ensure all drainfield sites are protected. <br />2. Site Lighting. The tennis court will be converted to a hockey rink in the winter. They intend <br />to provide lighting around the structure. This has raised the concern of at least one nearby property <br />owner. That property owner has stated that night lighting has been an issue in this neighborhood in <br />the past, and in rural Orono in general. The Planning Commission felt consideration should be given <br />to use of shoebox downward cast lighting with diffusers of some sort to reduce the impacts of <br />reflective glare. <br />STAFF RECOMMENDATION: <br />Staff recommends approval of the application subject to the conditions as noted in the Planning <br />Commission recommendation. <br />In addition to the Planning Commission recommendation, staff recommends the area of fill and truck <br />traffic on Lot 5 be reduced and that applicants take extra precautions to avoid any disruption within <br />50' chested sites, to allow for future flexibility. <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution.
