Submittal of a declaration for the preservation of wetland buffers which must be executed <br />and recorded <br />Background: <br />The appHcant is proposing to construct tennis court at the location cited above in the City of <br />Orono. The site contains of an existing wetland of greater than. five acres in size which wil1 not <br />be impacted by filling or excavation as a result of the proposed project. The applicant is <br />requesting a variance from the buffer requirements of Rule D due to site restrictions (see below). <br />Perm.its would allow for the grading, construction of impervious surface, establishment of <br />wetland buffer and wetland buffer impacts. <br />Rule'B: <br />Erosion control consisting of silt fence has been provided throughout the site. <br />Ryle D: <br />As stated above, one wetland of greater than five acres in size (DNR PW 862W) currently exists <br />on site. The applicant has proposed a 35-foot buffer in accordance with Rule D, but has <br />requested a variance for a portion of the buffer (see below). <br />Rule I: <br />A variance has been requested from Rule D to allow the construction of the tennis court within <br />298 square feet of the required wetland buffer. Because the wetland encompasses a large portion <br />of the property, the applicant has cited a Jack of avajlable upland area to accommodate both the <br />tennis court and the required buffer. The applicant has proposed to dedicate an additional 775 <br />square feet upland area adjacent to the wetland as compensatjon for the proposed buffer impacts. <br />Attachments: <br />1.
