CALIFORNIA <br />SPRINGFIELD, ILLINOIS <br />TAMPA, FLORIDA <br />WAUKEGAN, ILLINOIS <br />We have had an opportunity to review your correspondence of July 20, 1999, the title <br />report of the property subject to the above-referenced zoning file, the City of Orono Resolution <br />No. 4313 and the Drainage and Utilities Easement you and Susan D. Wilson signed in favor of <br />the City. Upon review of the resolution, I found that Mrs. Wilson's name had been corrected on <br />the resolution to read "Susan D. Wilson." Prior to recording the Resolution and the Easement, <br />the real estate taxes payable in 1999 for all of the property subject to the pending subdivision <br />must be paid in full. I am advised by the Hennepin County Treasurer's office that only the first <br />half have been paid. If your mortgagee pays your real estate taxes, perhaps we can wait until <br />after October 15, 1999, to record the documents. Please return the original partial release of <br />mortgage to me to be recorded with the subdivision documents and, if you would like to have the <br />subdivision documents recorded earlier than October 15, 1999, please also return a check to me <br />made payable to the Hennepin County Treasurer for the second half taxes. <br />I have confirmed with the City that the easement vacation was approved at the Council <br />meeting on August 9. I should be receiving a certified copy of that resolution shortly and will <br />record it simultaneously with the subdivision documents. With respect to amending the <br />Declaration of Easements, Covenants, Conditions and Restrictions of Abingdon Glen and the <br />Declaration of Private Road Easement relating to Abingdon Way, I have not received a copy of <br />either of these documents for review. I do believe, however, that the procedures set forth in both <br />of these documents for amendment must be followed to release a portion of Lot 5 from the <br />restrictions and conditions set forth therein.
