You may be contacted by the City Attorney if additional information is
required ( this will not be sent to the City Attorney until the vacation process has been
completed). Lot line rearrangements which result in the transfer or exchange of parcels will
not be recorded on your title until deeds are exchanged and filed by the property owners.
Deed exchange and filing is the responsibility of the property owners.
There are a number of items which must be completed by you prior to filing, including:
1. Provide 3 copies of the survey containing signatures of all persons with an interest
in the property. These copies must also be signed by the City Clerk and the Mayor.
2. Provide a signed/notarized original of the drainage and utility easement ( original
attached).
3. Provide confirmation of legal ownership of both properties in a form acceptable to the
City Attorney.
Per my discussion with Mr. Wilson, vacation of the Lot 5 drainage and utility easement will
be placed on the Planning Commission's July 19 agenda for action. The attached survey
excerpt indicates the portion of easement proposed to be vacated. Please contact Mike Gaffron
or Paul Weinberger at 249-4600 if you have any questions on this. Questions regarding filing
of the documents may be referred to Nancy Chadwick at the City Attorney's office (612-334-
2529).
If you desire certified copies of the official Council minutes, they are available from the City
Clerk after review and approval by the City Council.
cc: Nancy Chadwick
