_'.±.-. y; <br /> � Cit� of ORONO <br /> � RESOLUTION OF THE CITY COUNCIL <br /> • <br /> NO. 1330 <br /> .�• � • • <br /> A RESOLUTION APPROVING AN AFTER THE FACT <br /> CONDITIONAL USE PERMIT FOR ROGER VEON <br /> FOR THE DREDGING OF A WILDLIFE POND ON <br /> PROPERTY LOCATED AT 1330 SIXTH AVENUE NORTH <br /> WHEREAS, t�e City of Orono is a Municipal Corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, pursuant to State Statute 412 et. seq. and 463 et. seq. , <br /> the City Council of the City of Orono has adopted zoning regulations for <br /> the protection of the public health, safety and welfare; and <br /> WHEREAS, pursuant to Section 31. 832 (b) of the Orono Zoning Code, <br /> Roger Veon has been required to file an application for a conditional use <br /> permit for the dredging of a wildlife pond within a designated wetland <br /> area without City' s approval on property located at 1330 Sixth Avenue <br /> North; and <br /> WHEREAS, the• City Council has reviewed the application; the <br /> •recommendations of staff and the Planning Commission; the oral and written <br /> comments made by the applicant; the City Council makes the following <br /> ""findings of fact: <br /> 1) The Veon property is 2. 6 acres in area and legally <br /> described as Lot 4, Block l, Underhill Farm. <br /> 2) The wildlife pond is approximately 30 ' x 288 ' or <br /> 6840 sf in area. <br /> 3) The pond is located within a designated wetland <br /> area. � <br /> 4) The wetland has existed for several years and . <br /> was reported to have been created by the gradual <br /> � deterioration of an extensive underground drainage <br /> system, draining from the northeast and northwest. <br /> 5) The area of the spill out on the Veon property was <br /> described as wet and mucky inhabited by mosquitos <br /> and snakes. At times of a heavy rainfall the area <br /> became a drainageway creating a waterfalls over the <br /> property to the south and causing severe erosion. <br /> 6) The pond area affords a retention basin for the <br /> excessive drainage and has alleviated the erosion <br /> of the steep banks on property to the south. <br /> 7) The Hennepin Soil and Water Conservation District <br /> has reviewed the project finding the pond envi- <br /> ronmentally sound for wildlife habitation. . <br /> � <br />
