.s;C � <br /> �. <br /> l Clt� o�` ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � NO. � ��7 <br /> ' � - � � A RESOLUTION APPROVING A CONDITIONAL USE <br /> PERMIT FOR JOAN LUNDQUIST FOR A RESTAURANT <br /> LOCATED AT 3416 SHORELINE DRIVE <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, pursuant to State Statutes 412 et. seq. and 463 et. seq. , <br /> the City Council of the City of Orono has adopted zoning regulations for <br /> the protection of the public health, safety and welfare; and <br /> WHEREAS, pursuant to Section 35. 024 of the Orono Zoning Code, <br /> Joan Lundquist has applied for a conditional use permit as the new <br /> owner-operator of the Mexican Inn located at 3416 Shoreline Drive; and <br /> WHEREAS, after review of the Planning Commission and City staff, <br /> the City Council hereby makes the following findings of fact: <br /> 1) The new owners plan no physical changes of the <br /> • existing' structure nor any changes in the interior <br /> design. <br /> 2) The kitchen will continue to serve fxom a traditional <br /> Mexican menu. <br /> 3) The owner and her daughter will be the sole operators <br /> of the restuarant. <br /> 4) The hours of operation are as follows: <br /> Monday - Thursday 11: 30 AM - 2: 00 PM, 5: 00 PM - 8 : 00 PM <br /> Friday - 11: 30 AM - 2 : 00 PM, 5: 00 PM - 9: 00 PM <br /> Saturday 5: 00 PM - 9: 00 PM <br /> 5) Additional parking is provided in the rear and <br /> and side parking lots. <br /> 6) The existing signage for the restuarant satisfies � <br /> all code requirements of Section 38. 031. <br /> 7) The City Council approved a beer license for the <br /> Mexican Inn at their September 28 , 1981 meeting. <br /> 8) The proposed use is in accord with the intent and <br /> objectives of the zoning code and the purpose of <br /> the B-1 zoning district. <br /> 9) The proposed use is in accord with the intent and <br /> objectives of the Orono Comprehensive Lane Use Plan. , <br /> 10) The location of the conditional use and the proposed � <br /> conditions under which the restaurant wou�d be <br /> operated or maintained are not detrimental to the <br /> public health, safety or welfare. <br /> � � <br />
