File #1254 <br />Page 2 <br />Applicant has appealed to the City to waive the requirement for sprinkling <br />the building. Staff advised the Planning Commission at the time the <br />applicant made the request that they had no authority to deal with such <br />matters as this clearly involved state regulations and there were certain <br />procedures to be followed under those regulations. Staff was asked by the <br />Planning Commission to get thi3 confirmation in writing from the State <br />Building Code Division. This had been done by Mr. Jacobs. <br />Please review Exhibits Q and S. we would advise Council to allow staff to <br />deal with the established procedures already setforth in state statute and <br />that applicant will be provided tF � ability to present their alternate <br />method to a Board of Appeals. <br />Staff issued a land alteration permit to the church at the end of last year <br />to allow the expansion of the parking lot. It was the understanding of <br />staff that there would be no more than 100 cubic yards removed and blacktop <br />applied to the area. There was never any consideration given to <br />stockpiling of any additional fill resulting from that grading work. At <br />the time of the site inspection, staff discovered approximately 300 cubic <br />yards of fill placed to the northwest of the existing structure. Staff has <br />no authority to allow 300 cubic yards of disturber: earth to remain and <br />advised the applicant that they would have to remove it from the site or <br />else seek approval from the City for a Conditional Use Permit. <br />Please review Mr. Brownlee's letter of 4/28/88, Exhibit U. Mr. Brownlee <br />asked for the City's special consideration to allow the existing fill to <br />remain and to be included with the stockpile of fill from the excavation <br />for the new addition to be later used for the final grading around the <br />site. Staff has no problem with this as long as there are no changes in <br />the proposed elevation shown on the final approved grading plans. <br />The enclosed <br />staff Resolution has been <br />drafted per the <br />Planning Commission <br />recommendation <br />and the recommendations <br />sighted by staff <br />above that would <br />require the <br />installation of a new <br />septic system <br />and to approve a <br />Conditional <br />Use Permit for the additional <br />fill that <br />resulted from the <br />expansion of <br />the parking lot, such fill <br />to remain until <br />final grading. <br />
