A RESOLUTION APPROVING THE PLAT OF <br />BETZ ADDITIOT: <br />APPLICATION NO. 1232 <br />WHEREAS, the City of Orono, is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision regulations for the orderly, economic and safe development of <br />lands in the City; and <br />WHEREAS, the City Council has considered the application for <br />a subdivision of a five lot plat by Betz Builders Incorporated and Clemmert <br />C. Kroll, the subdividers; and <br />WHEREAS, the subdivision has been found to meet all standards of <br />the RR-lB rural residential zoning district finding that each lot is of a <br />size and configuration that will allow its use as a single fa .;l ly residence <br />to be fully developed without the need of any variances; and <br />WHEREAS, the subdivider has completed all requirements of the <br />platting regulations of the City, inclining: <br />1. Completion of all the requ_ cements of Resolution No. 2364. <br />2. Dedication on the pl,-t of right of way for a public road shown as <br />Stubbs Bay Road. <br />3. Creation of a new private road shown on the plat as outlot B, to <br />be known hence forth as Christine Drive. <br />4. Concurrent with the creation of this private road, the <br />subdividers have dedicated to the City a road and utilities easement <br />granting to the City permanent access, improvement and utilities <br />easements over said outlot; the subdividers have created nonexclusive <br />ingress, egress, drainage and utilities easments over said outlot in <br />favor of abutting and/ or benifiting lots including a declaration of <br />certain maintenance covenants where in each of the abutting and/ or <br />benifiting lot owners covenants and agrees to permanently maintain and <br />pay the cost of maintance for said private road. <br />5. Dedication to the City of a flowage and conservation easement <br />providing for limitations on wetlands and drainagQway described there <br />in and shown on the plat as drainage easements. <br />6. Execution of a development agreement providing for installation <br />of certain improvements as a condition of subdivision approval. <br />Page 1 of 2 <br />
