Mabusth, Building & Zoning Administrator <br />Date: February 10, 1988 <br />Subject: #1218 Estate of Ruth Smith/Cedrick Dettloff, <br />385 Orono Orchard Road South - <br />- Preliminary Subdivision (Class III) - Second Review <br />List of Exhibits <br />Exhibit A - Section 12, Subdivision 4 (Specifically A & F) <br />Exhibit B - Septic Design Manual (3A) <br />Exhibit C - State Code Table 4 <br />Exhibit D - Gaffron Memo & Sketch <br />Exhibit E - Planning Commission Minutes of 11/16/87 <br />Exhibit F - DNR Map - Protected Wetlands <br />At your November 16, 1987 meeting, the application was tabled pending <br />resolve of the location of the existing septic system within Lot 1, need <br />for the realignment of the shared lot line providing a future access <br />corridor for Lot 2 if developed at some point in the future, and <br />determination as to the type of wetlands within Lot 2 not currently shown <br />on the preliminary plat. <br />Edward Callahan has advised that a preliminary purchase agreement with <br />the MacMillians, adjacent property owners, has been executed pending <br />resolve of the subdivision application. In preliminary discussions with <br />the representative of the MacMillians, staff was advised that there was no <br />plan to continue renting the existing structure nor make any use of the <br />existing accessory structures. The need to realign the lot line appears no <br />longer necessary since there is no plan by the new owner to subdivide the <br />property and would effectively function as a lot line rearrangement. In <br />any case, the current use of the existing driveway as a shared driveway <br />would be approved based on the two -lot use. The subdividers and future <br />owner of Lot 2 must Le made aware that if the alignment for future access <br />i.s not provided at this time, if Lot 2 is further subdivided, that the <br />pressent easement access will not be approved for additional lots. The <br />wetlands adjacent to Orono Orchard Road is a DNR protected wetlands and <br />cannot be filled. Access must be provided via adjacent properties. The <br />final itsolution approving the plat will clearly state that the present <br />shared drive is only acceptable at a two -lot use level. If Lot 2 is <br />divided in the future, the existing access easement is not acceptable. <br />Per Mike Gaffron's memo (Exhibit D), staff clearly cannot recommend <br />that any ditching be done at this time of the year. This need not delay <br />preliminary plat approval but staff must recommend against granting final <br />plat approval until the City is assured of the exact location of the <br />drainfield serving I.ot 1 in relation to the proposed lot line. Per Section <br />12, Subdivision 4 (A) & (F) and the Design Manual Section 3 (A) (Exhibits A <br />& B), subdivision approval cannot be finalized until the septic standards <br />have been satisfied.
