A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 13,10.22, <br />SUBDIVISION 2, SECTION 10.03, <br />SUBDIVISION 15(F), AND <br />SECTION 10.25, SUBDIVISION 6(B) <br />FILE #1260 <br />WHEREAS, John Nyyuist (hereinafter "the applicant") is the owner <br />of the property located at 1432 Baldur Park Road within the City of Orono <br />(herein-ifter "City") and legally described as fc4lows: <br />Lot 7, Block 1, Baldur Park, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.03, Subdivision 13 and 10.03, Subdivision <br />15(F) to allow construction of a detached garage to be located 5' from the <br />side lotline and 20' from the street lotline where a side setback of 10' <br />and a street setback of 30' are normally required, and for a variance to <br />Section 10.22, Subdivision 2 to allov hardcover in excess of the 25% <br />hardcover normally allowed in the 75-250' lakeshore setback zone. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File 41260. <br />2. The property is located in the LR-IC Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on April <br />18, 1988 and recommended approval of the proposed variance based upon <br />the following findings: <br />A) The existing garage located 2' from the side lotline will be <br />replaced with a neeā¢, larger garage located 5' from the lotline. <br />The 5' side setback variance is justified by the need to maintain <br />an adequate corridor to the right side of the garage for future <br />well maintenance access, and will provide a more useful yard area <br />than if the garage was centered on the property. <br />Page 1 of 5 <br />
