City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING A CONDTIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE SECTION 10.03, SUBDIVISION 19 <br />AND SECTION 10.20, SUBDIVISION 3 (D) AND A VARIANCE PER <br />MUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 2, FOR <br />THE METROPOLITAN WASTE CONTROL COMMISSION - FILE #1256 <br />WHEREAS, the Metropolitan Waste Control Commission (hereinafter <br />"the applicant") has made application to the City of Orono (hereinafter <br />"City") to permit the installation of sewer lines within major portions of <br />the right of way of County Road 51 and County Road 19 to be constructed <br />within two defined phases of construction. Beginning in the summer of 1988 <br />and - ding in the late summer of 1989, the sewer project will involve the <br />follf 1.ng land alterations and improvements: <br />1. A Conditional Use Permit per Section 10.03, Subdivision 19 for <br />the grading and filling activites involving more than 100 cubic yards <br />of fill. <br />2. Per Section 10.20, Subdivision 3 (D) a Conditional Use Permit is <br />required for the major upgrading of 3 lift stations and the <br />installation of 2 new lift stations. <br />3. Per Section 10.22, Subdivision 2 for the excavation and filling <br />work and the installment of sewer lines within 75' of Lake Minnetonka. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1256. <br />2. The Orono Planning Commission reviewed this application on March <br />21, 1988, and recommended approval of the Conditional Use Permit and <br />Variances as proposed based on the following findings. <br />a. MWCC study has confirmed that the existing sewer lines and <br />lift stations have reached capacity. In order to solve the <br />capacity problems a parallel sewer line will be installed <br />in addition to vacating existing lift stations and installing <br />lift stations with greater capacity. <br />b. Erosion control throughout the project will assure water <br />quality/runoff to Lake Minnetonka will not be affected. <br />C. The City received no negative comments from any of the <br />neighbors notifed within 350' of each of the 5 lift station <br />installations. <br />Pagv 1 of 3 <br />
