Attorney's Opinion Dated 3/1j187 <br />ISSUE - Transmission of information to Council regarding its <br />rights vis-a-vis the County relating to jurisdiction over a <br />current M.S.A. street. <br />INTRODUCTION - At Council's last meeting the issue of 116 being <br />exten ed from Highway 55 down to Highway 12 along Willow was <br />discussed. At that meeting the issue regarding the City's <br />ability to prevent Hennepin County from taking over the Orono <br />section of Willa-. should they desire to build it, was discussed. <br />It was requesteu t the City Attorney research the issue. <br />DISCUSSION - Based on a review by the Attorney it is our present <br />understanding that while the County may have some authority in <br />taking over the road from the City as it currently exists, a <br />M.S.A. street, the legality of the situation would require a <br />court hearing on the matter. Additionally since the road request <br />is one initiated by the City of Medina and not Hennepin County it <br />is not anticipated that the County would not force the issue and <br />may drop the entire project if Orono is in opposition. <br />RECOMMENDATION - That the Council accept the information from the <br />C y—Attorney and that upon Medina taking formal action on the <br />matter a public hearing be scheduled for the City of Orono. <br />PROPOSED MOTION - Moved by, seconded by , to accept the <br />Attorneys information on the �atter arip',table a matter until a <br />future public hearing.
