A RESOLUTION GRANTING <br /> VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.22, SUBDIVISIONS 1 AND 2 <br /> AND SECTION 10.56, SUBDIVISION 16 (L) <br /> FILE #2050 <br /> WHEREAS, William Toles (hereinafter "the applicant") is owner of the property <br /> located at 3165 North Shore Drive within the City of Orono (hereinafter "City") and legally <br /> described as follows: <br /> Exhibit A attached (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for variances to Municipal <br /> Zoning Code Sections 10.22, Subdivision 2 and 10.56, Subdivision 16 (L) to permit the <br /> construction of a swimming pool which results in hardcover in excess of the 25% hardcover <br /> normally allowed in the 75-250' lakeshore setback zone, and a variance to Section 10.22, <br /> Subdivision 1 to allow such swimming pool to encroach past the average lakeshore setback line <br /> where no encroachment is normally allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2050. <br /> 2. The property is located in the LR-1B, Single Family Lakeshore Residential <br /> Zoning District. <br /> 3. The Orono Planning Commission reviewed this application on August 21, 1995, <br /> and recommended approval of the proposed variances based upon the following <br /> findings: <br /> Page 1 of 7 <br />
