*01 i Ike( c f- l2( n,i <br /> to—• Goi f?"S�r <br /> , <br /> I � p <br /> October 15, 2009 <br /> City of Orono <br /> Planning and Zoning Commission <br /> Orono, Minnesota <br /> Dear Planning and Zoning Commission Members: <br /> We are the residents of 3135, 3145, 3155,and 3175 North Shore Drive and are collectively replying to <br /> the notice of a proposed alteration to 3165 North Shore Drive by Wagener Properties, LLC. <br /> Although we are not opposed conceptually to the reconstitution of the subject property to a more <br /> natural state,we are concerned about several of the projects aspects. Specifically, our review of the <br /> proposed work creates the following concerns: <br /> • 225 truckloads of fill will be needed to complete the project. Clearly,450 trips by heavy <br /> machinery(20 to 30 times heavier than a typical car)over our driveway in common will <br /> cause damage to the point whereby repair will be a mandate. es troy <br /> The existing driveway in common is the one and only egress and <br /> access to our homes and its condition has a material impact to our property utilization <br /> an value. No singular or collective agreer ent exists to restore the driveway to a <br /> reasonable condition. We feel that such an agreement needs to be a precedent to any <br /> activity, <br /> • The engineering company(Bonestroo) reviewing the project has expressed concern over <br /> the resulting drainage post completion./We see no documentation as to how this issue <br /> has been addressed and satisfied.. <br /> • There is no mention as to the length of time the project will take. Accordingly,we are <br /> concerned that tie length of the project may negatively impact our peace and quiet <br /> over a prolonged period, <br /> • There is no mention as to how the common driveway will be kept clean and mud free <br /> during the project. With over 2200 yards at fill,there will be a tremendous amount of <br /> potential mud, dirt,and dust. Our homes will be negatively impacted by this event yet <br /> no mention or plan to address this potential damage is apparent. <br /> • There appears to be no remedy for any ancillary damage which may occur due to the <br /> size and scope of the project, Although it is impossible to predict whether or not any <br /> such damage will occur, none of us are irate ested in chasing compensatory fees should <br /> this concern become a fact. We are requesting that an agreement be drafted amongst <br /> - <br /> all parties clearly outlining the respective re possibilities of all five easement holders <br /> that utilize the common driveway before any work is commenced. <br /> • It should be noted that Wagener Properties, LLC has another access point directly off of <br /> Bohns Point Road, referenced by Bonestroo,which would accordingly have no impact <br /> on the residents of the North Shore Drive common driveway. The use of the Bohns <br /> Point access may be a better solution altogether. <br />
