City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />1757 <br />A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.20, SUBDIVISION 3 (G) <br />FILE NO. 905 <br />WHEREAS, Dennis Thompson (hereinafter "the applicant") <br />has an interest in the property located at 250 Old Crystal Bay <br />Road within the City of Orono (hereafter "City") and legally <br />described as follows: <br />That part of Lot 1, Auditor's Subdivision Two Hundred <br />twenty-nine (229), Hennepin County, Minnesota, according to <br />the plat thereof on file or of record in the office of the <br />Registrar of Titles in and for said county, lying Southerly <br />of a line drawn parallel with and 240 feet Southerly of, as <br />measured at right angles to, the North line of said Lot 1 <br />and lying Westerly of a line drawn parallel with and 1,070 <br />feet Easterly of, as measured at right angles to, the West <br />line of said Lot 1 (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />Conditional Use Permit per Municipal Zoning Code Section 10.20, <br />Subdivision 3 (G) to permit a guest/caretaker apartment within <br />the residence located at 250 Old Crystal Bay Road. <br />FINDINGS <br />1. This application was reviewed as Zoning File No. 905. <br />2. The property is located in the RR-1B Rural Residential <br />Zoning District. <br />3. The property contains approximately 16 + acres of area. <br />4. The property can meet the required area standard for two <br />residental units. <br />5. The apartment is for the sole use of the owner and shall <br />not be rented. <br />6. The Orono Planning Commission reviewed the application <br />at their meeting of April 15th, 1985 and voted unanimously <br />to recommend approval of the application finding that it <br />satisfied all standards of Section10.20, Subdivision 3 (G). <br />7. The City Council has considered this application in- <br />cluding the findings and recommendations of the Planning <br />Commission, reports by staff and comments of the applicant <br />and the effect of the proposed use on the health, safety and <br />welfare of the community. <br />Page 1 of 3 <br />
