,. -,-r� <br /> � . <br /> _ Cit� of ORONO <br /> � <br /> � RESOLUTION OF THE CITY COUNCIL <br /> � NO. 1312 - <br /> • <br /> • • � ± RESOLUTION ORDERING PREPARATION OF A <br /> �`��` �'``'" `v SEWER AND WATER FEASIBILITY REPORT FOR <br /> 2477 DUNWOODY AVENUE. <br /> • WHEREAS, for the purpose of protecting the public health <br /> and safety and for promoting the most general public welfare, the City <br /> has adopted Ordinance No. 210 , The On-Site Sewage Treatment Code, which <br /> ordinance regulates the proper design, location, construction, altera- <br /> tion, use and maintenance of on-site sewage treatment systems , and which . <br /> ordinance established a program for inspection of existing on-site <br /> systems to assure a minimum, adequate level of sewage treatment in the <br /> City; and <br /> WHEREAS, this inspection program has identified a parcel of <br /> property located at 2477 Dunwoody Ave, PID 20-117-23-22-0015 , which <br /> property is located within the urban sewer service area of the City and <br /> which property contains a malfunctioning or inadequately functioning <br /> septic system located within 15 feet of Lake Minnetonka; and <br /> . WHEREAS, 2477 Dunwoody Ave. is a land-locked parcel of land <br /> not abutting any public street or right-of-way; and <br /> , WHEREAS, a sewer stub is available on Dunwoody Avenue, which <br /> service has not been extended to the actual property line of this <br /> property; and <br /> WHEREAS, this property has been assessed for sewer trunk <br /> availability but has never been assessed for sewer unit or sewer lateral <br /> service; and <br /> WHEREAS, a11 adjacent properties do directly abut Dunwoody <br /> Ave. , are already connected to municipal sanitary sewer and were assessed <br /> for sewer trunk, unit and lateral charges; and <br /> WHEREAS, a water main stub .assigned for this proerty is <br /> available on Dunwoody Ave. and this property has been assessed for <br /> municipal water service availability; and <br /> ' WHEREAS, it is proposed to extend sanitary sewer and municipal <br /> water service stubs from Dunwoody Avenue to the actual property line of <br /> this subject property and to assess said property for all or a portion . <br /> of the improvement pursuant to Minnesota Statutes Chapter 429. <br /> • � . <br />
