k <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION APPROVING AN AMENDMENT <br />OF nRONO RESOLUTION NO. 2295 <br />THAT WOULD CONTINUE TO GRANT A VARIANCE <br />TO MUNICIPAL CODE SECTION 10.22, SUBDIVISIGN 2 <br />WHEREAS, Rol' in Lacy (hereinafter "the applicant") is *he owner <br />or the property located at 2655 North Shore Drive within the City of Orono <br />(hereinafter "the City") and legally described on Exhibit A attached <br />herewith (hereinafter "she property"); and <br />WHEREAS, the applicant has applied to the City for the purpose of <br />amending the original variance approval that would have allowed a total of <br />12,995 s.f. or 35.2% of hardcover within the 75-250' setback area and would <br />now seek approval of 12,825 s.f. or 34.7% of hardcover for a total net <br />reduction of a 130 s.f. or .4%. <br />Minnesota: <br />NOW, THEREFORE, BE TT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as an amendment of Resolution No. <br />2295, originally reviewed as Zoning File No. 1213. <br />2. This amendment involves a request to maintain an accessory <br />structure, originally scheduled for removal. measuring 14.4" by 16'4", <br />totaling 236.16 s.f. in hardcover. In exchange, the appl'-ant har, <br />;,c:rer,d to not construct approximately 366 s.f. of proposed deck area <br />within the lakeshore yard. <br />3. The Orono Council reviewed the applicant's request on April 11, <br />1988 and r.ecormended approval of the proposed amendment to Resolution <br />No. 2295, File No. 1213, based upon the following finding <br />A) The proposal will result in an overall reduction of 130 s.f. <br />of structural hardcover or .4% within the 75-250' setback area. <br />B) The accessory structure has historical value to the property <br />and is reported as one of the first structures on this property. <br />C) The subject structure meets all required setbacks. <br />D) There has been no change in the 0-75' setback area, still <br />maintained at Ohs hardcover, and the 250-900' setback area remains <br />at 9.21 of hardcover. <br />4. The City Council has considered this request including the reports <br />by City staff, comments by the applicant and the effect of the <br />proposed variance on the health, safety and welfare of the community. <br />Page 1 of 3 <br />
