Tnere will be n- <br />changes required in the cities' address listings and direct <br />access from Shadywood will still be available, if necessary. <br />The primary nature of this request is to improve the safety <br />and ease of access to Mr. Huber's property. <br />2. Proverty Iaorovg ept. Approval of this easement request <br />will allow Mr. Huber to improve both his property dnd the <br />city -owned property. As you are aware, Mr. Huber has already <br />substantially improved his property in the past year and he <br />intends further improvement. Due to the current neglected <br />state of repair of the city's property, improper grad`.ng in <br />the past, and culvert problems, run. -off flows onto Mr. <br />Huber's front lawn, occasionally resulting in standing water. <br />This problem was recognized in Mr. Huber's variance request <br />last year. Mr. Huber had planned to request city approval <br />for his own improvement. of the dri'.e, regrading and <br />blacktopping it, in order to resolve the problem. In the <br />event that this request is not approved, Mr. Huber will seek <br />to have the city regrade the drive and fix the culvert to <br />prevent further damage to his property. <br />3. Q='Qraity with Neighborhood Wishes. Approval of this <br />easement request will respond to neighborhood concerns about <br />the saretf- of Shadywood Road around this curve, while not <br />increasing (and likely decreasing) traffic o,, the city's <br />property. Mr. Huber <br />and his neighbors want to restrict throuo.i traffic frorr. <br />Pheasant Road using the pillar drive. Neighcors have access <br />to their properties from Kelly Avenue or Pheasant Road while <br />only one adjacent property owner will occasionally use the <br />pillar drive. Other people from the area cut through these <br />back yards, across the City's land, and use the privately - <br />owned pillar drive . Mr Huber wants acceptance of his use of <br />that strip and, with his neighbors, the opportunity to <br />control Traffic through their back yards. <br />I am aware that the city staff has expressed reluctance at <br />approving more than one access to a lot. However, it must be <br />recognized that Mr. Huber is in a unique `ocation and that his <br />circumstances are special. Direct access to Shadywood Road is <br />both difficult and dangerous due to the nature of Mr. Huber's <br />site location. The city strip seems to have been intended to <br />provide access to l�t.s along Shadywood, as well as to the city <br />pumping station. There is no overriding policy reason against <br />having more than one access to property, e.,.;ecially where the <br />
