DEED OI' APPURTENANT EASEMENT <br />THIS INDENTURE, made arid entered into this day of <br />, 1988, by and between the City of Orono, a <br />Minnesota municipal corporation, Grantor, rnd Thomas P. Huber <br />and Nancy Huber, husband and wife, Grantees, <br />WITNESSETH, WHEREAS said Grantor is the owner of that certain <br />tract of land in the County of Hennepin, State of Minnesota, <br />described as follows: <br />That part of Lot Five (5) lying Northerly of the line <br />drawn parallel to, an.i Forty (40) feet distant Southerly <br />from the Nortl e. •1 y "° ne of said Lot Five (5), "Pheasant <br />Lawn", accordir. the plat thereof on file and of <br />f_ record in the Oof the Registrar of Titles in and <br />for Hennepin Count;, State of Minnesota. <br />Subject to covenants and restrictions, etc., as contained <br />in DeeO Document Number 209388. <br />WHEREAS, Thomas P. Huber and Nancy Huber, husband and wife, <br />are the owners of that certain tract of land described as <br />follows: <br />Lot 4 and that hart of Lot 3, "Pheasant Lawn", described <br />as follows: commencing at the Northwesterly corner of <br />said Lot; thence Easterly along the Northerly line of <br />said Lot a distr_nce of 51.65 feet; thence Southerly to a <br />point on the Southerly line of said Lot distant 50 feet <br />from the Southwesterly corner of said Lot; theme <br />Westerly along the Southerly line of said Lot 50 feet; <br />thence Northerly along the Westerly line of said Lot to <br />the point of beginning, according to the plat thereof -:n <br />file and of record in the Office of Registrar ­` Titles <br />in and for Hennepin County, State of Minnesota, <br />Subject to restrictions, covenants and easements of <br />record, if any, <br />WHEREAS, said Grantor and Grantees have agreed upon the <br />easement hereinafter described: <br />NOW THEREFORE, the said Grantor, in consideration of TEN AND <br />NO/100THS ($70.00) Dollars and other good and valuable <br />consideration, receipt of which is hereby acknowledged, hereby <br />grants to said Grantees, their heirs and assigns, a permanent <br />non-exclusive easement fur ingress and egress in, over, and <br />upon, all of said land of said Granter. <br />- 1 - <br />
