DEED OF APPURTENANT EASEMENT <br />THIS INDENTURE, made and entered into this day <br />of , 1988, by and between the City of <br />Orono, a Minnesota municipal corporation, Grantor, and Dallas <br />C. Messer and Virginia G. Messer, husband and wife; and David <br />Cookson and Anne Marie Cookson, husband and wife, Grantees, <br />WITNESSETH, WHEREAS said Grantor is the owner of that certain <br />tract of land in the County of Hennepin, State of Minnesota, <br />described as follows: <br />That part of Lot Five (5) lying Northerly of the line <br />drawn parall,t to, and Forty (40) feet distant Southerl} <br />from the Northerly line of said Lot Five (5), "Pheasant <br />Lawn", according tc the plat thereof on file and of <br />record in the Office of the Registrar of Titles in and <br />for Hennepin County, State of Minnesota. <br />Subject to covenants and restrictions, etc., as contained <br />in Deed Document Number 209388. <br />and, <br />WHEREAS, Dallas C. Messer and Virgir.a G. Messer, husband and <br />wi.fe,are the owners of that certain tract of land described a3 <br />follows: <br />Lot Five (5), except the North Forty (40) feet thereof, <br />"Pheasant Lawn", according to the plat there of on file <br />and of record in the Office of the Registrar of Titles in <br />and for Hennepin County, State of Minnesota, <br />Subject to covenants, easements and restrictions of <br />record, if any, <br />which adjoins said land of said Grantor on the South, and <br />WHEREAS, David Cookson and Anne Marie Cookson, husband and <br />wifi, are the owners of that certain tract of land described <br />as follows: <br />Lots 1 and 2, and Lot 3, except that part thereof <br />described as follows: Commencing at the Northwesterly <br />corner of said Lot; thence Easterly along the Northerly <br />line of said Lot a distance of 51.65 feet; thence <br />Southerly to a point on the Southerly line of said Lot <br />distant 50 fee* from the Southwesterly corner of said <br />Lot; thence Westerly along the Southerly line of said Lot <br />50 feet; thence Northerly along the Westerly l-ine of said <br />Lot to the point of beginning, all in "Pheasant Lawn", <br />according to the plat thereof on file and of record in <br />the Office of Registrar of Titlec in and for Hennepin <br />County, State of Minnesota, <br />- 1 - <br />
