Ordinance No. 5.30 - Solicitors <br />ISSUE - Consideration by the Council as to any additional action they may <br />desire to take in the regulation of peddlers in the Community. <br />INTRODUCTION - <br />At the Council's March 14, 1988 meeting, the Council discussed a <br />letter from Helen Skaret together with a petition that had accomr,:hied that <br />from the various Orono business people. At that meeting, the Coureil. chose <br />to take no action. The person who had sent the letter was unaware that it <br />was going to be on the agenda and in a conversation subsequent to that <br />meeting wondered when it would be considered. Based on the fact that they <br />had not been contacted, it was indicated that it would be placed on the <br />agenda again. <br />DISCUSSION - <br />As noted in Attachment A, this issue was discussed at. the March 25, <br />1985 Council meeting. Concern expressed at the time was that the <br />individual had a right to be able to peddle under the City's ordinance <br />regarding licensing of peddlers provided they committed no violations of <br />the ordinance. <br />Consideration of this matter from a zoning standpoint, however, has <br />not previously been done. The individual has been soliciting on property <br />that has been coned residential property (LR-IC-1) although it presently is <br />used commercially as a non -conforming use. To the extent that the zoning <br />ordinance does not allow for anything other than home occupations, which <br />are not to show outside the home or road -side stands for produce grown on <br />the property, it is an on -going business in an "established place" (refer <br />to Ordinance 5.30 for the definition), and therefore would only be <br />permitted in a commercially or business zoned area. To that extent, the <br />individual could be licensed on an on -going bcis;;, however, they would have <br />to change locations and get the permission of the property owner of a <br />commercially zoned property to conduct his business. <br />ALTERNATIVES - <br />A. Pofi�_alternatives: <br />1. Leave ordinance un-amended. <br />2. Limit the peddler's license to number of days or number of <br />renewals within a years time. <br />
