Ordinance Section 9.13 <br />ISSUE - Provision of information regarding the citations issued <br />at the above address. <br />INTRODUCTION - The issue addressed by the resident at last <br />meeting dates back to at least 1977. The City in 1982-83 <br />proceeded to prosecute the case under a general nusiance <br />ordinance. This was settled by the attached stipulation. <br />Subsequent to the stipulation the City adopted Ordinance 9.13 <br />Subd. 14 as noted in Attachment B. Following complaints in the <br />spring of 1987 the City pursued a violation of this ordinance and <br />as noted in Attachment A will also pursue violation of the <br />stipulation related to efforts to discourage. The amount of <br />feeding allowed in the 1983 stipulation appears excessive to try <br />to accomplish the purpose of "efforts to discourage". In <br />addition the subsequent ordinance is now being violated. <br />The City's prosecutor is amenable to a negotiated settlement <br />within the guidelines outlined in Attachment A. <br />RECO14MENDATION - That Council accept information related to the <br />citation at 1972 Shadywood. Staff will have the City Attorney <br />reiterate the desire to settle the matter short of trial with the <br />resident's Attorney if it is within the guidelines outlined. <br />PROPOSED MOTION - Moved by , seconded by , that the OrDno <br />Council accept Lhe information regarding the ordinance violation <br />at 1972 Shadywood Road.
