The areas of Forest Boulevard, Vine Place and the park of Saga <br />Hill Revised serve no current public purpose and not futLre public <br />purpose or need. <br />5. The vacation of Forest Avenue prohibits installation of Forest <br />Boulevard as a through road. <br />If Planning Commission recommends the partial vacations as proposed, <br />the application may be acted on and presented for Council's formal action. <br />If Planning Commission wishes to expand on the present application, staff <br />would suggest that we table action until all affected property owners have <br />been contacted. If total vacation of Forest Boulevard is proposed, then <br />indeed problems such as Mr. Nelson's must be resolved prior to scheduling <br />it before Council for final action. <br />Additional Comments and Planning Commission Recommendation - 3/23/88 <br />Planning Commission listened to the comments of other property owners with <br />lots that abut Forest Blvd. and not included with the formal application. <br />They questioned whether the City would consider all of Forest Blvd. <br />exclusive of the 50' fire lanes (Buff St. and Summit Ave.). Staff advised <br />that Forest Blvd. no longer served any public purpose and that the City <br />could consider both the proposed partial vacation or the complete vacation, <br />but that if a total vacation is considered, staff would have to table the <br />application to allow additional time to review the impact on the adjoining <br />properties. In addition, start would have to determine the need for legal <br />publication., survey information, and need for additional fees. It was <br />clear that the majority of property owners present did not wish to do any <br />additional survey work or pay fees. The applicant, Audrey Schultz, advised <br />that she represented one of the nine applicants who had been prohibited <br />from making additions to their home because the mortgage company refused to <br />approve the refinancing because of the Forest Blvd. issue. She advised the <br />Planning Commission that she had contacted as many neighbors as she could <br />but she soon realized that there were some that had no intention of <br />entering into the application and asked the Planning Commission to please <br />act on the proposed application rather than delay her client any longer. <br />Planning Commission agreed and advised the other remaining property owners <br />to continue to work with staff so that the total vacation of Forest Blvd. <br />could be realized at some future time. <br />Planning Commission Recommendation - Planning Commission accepted the staff <br />findings and conclusions regarding the proposed vacation, and approved the <br />partial vacation as presented by Ms. Schultz. The enclosed nine <br />resolutions will be filed against the chain of title of eacti of the subject <br />properties upon official approval of the Council. <br />
