City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />!MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6(B) <br />FILE #1250 <br />WHEREAS, Dana M. Wells (hereinafter "the applicant") is <br />owner of the property located at 1397 Orono Lane within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Exhibit A (hereinafter "the property"); and <br />WHEREAS, the applicant ;as applied to the City for a <br />variance to Municipal Zoning Code Section 10.23, Subdivision 6(B) to <br />permit the construction of an attached garage located 14' from the <br />side property line instead of the required 30'. Applicant seeks <br />approval of a 16' variance or 53%. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Toning File #1250. <br />2. The property is located in the LR-lA Lakeshore Residential <br />Zoning District and requires a minimum of 2 acres in area and <br />200' of lot width. The property consists of 31,540 s.f. or .72 <br />acres and 106' in width. <br />3. The Orono Planning Commission reviewed this application on <br />March 21, 1986, and recommended approval of the proposed <br />variance based upon the following findings and hardships: <br />a) The property is 1r wide and contains a total of 31,540 <br />s.f. or .72 acres a subject to the LR-lA lut standard <br />that would requirt acres in area and 200' of width. The <br />current structure d(- s not satisfy the 30' side setback on <br />either the east or the west side. <br />b) The proposed structure does not encroach any further into <br />the substandard side setback area. <br />c) The elevatiGns and plantings along the west side <br />property line lessen the visual impact of the proposed <br />structure. <br />Page I of 4 <br />
